MERAKIVA TRAVEL BOOKING TERMS & CONDITIONS

 

  1. BOOKING CONTRACT

All bookings are made with Merakiva Travel Inc, a Delaware Corporation (hereinafter referred to as “Merakiva Travel,” “Merakiva”, “The Company”, “we,” “our,” or “us”), headquartered in the Commonwealth of Pennsylvania.

Please read these terms and conditions with utmost attention. By purchasing a multi-day group trip or overnight trip with Merakiva Travel (hereinafter referred to as a “Merakiva Trip,” “trip,” “group trip,” or “tour,” you acknowledge that you: i) have thoroughly read and understood these terms and conditions, along with any other Merakiva Travel policies currently in effect, and ii) accept and agree to be bound by these terms and conditions and other applicable policies set forth by Merakiva Travel. These terms and conditions represent the full understanding and agreement between you, the trip participant (“participant,” “traveler,” “you,” or “I”), and Merakiva Travel regarding any and all bookings, trips (which include, but are not limited to, group travel experiences), or transactions made with us, and to any and all services, and products organized, arranged, or provided by us. If you have confirmed a booking for a Merakiva Travel trip or product with more than one traveler named on such booking, you are considered to have accepted these terms and conditions on behalf of all travelers listed in the booking.

  1. RESPONSIBILITY

Merakiva Travel acts solely as an independent contractor for all suppliers providing your transportation, accommodations, activities, and other services in connection with your trip. Merakiva Travel does not own, manage, or control any of the service providers that deliver accommodations, meals, transportation, sightseeing activities, or other goods and services connected with your trip. These suppliers are solely responsible for their own performance. Merakiva Travel and its owners, employees, shareholders, officers, directors, representatives, volunteers, successors, agents, and assignees shall not be held liable for any negligence, willful act, financial insolvency, or default of any supplier or any third party. Merakiva Travel does not possess any special knowledge regarding the financial condition of its suppliers. The goods and services provided by a supplier are subject to the supplier’s own terms and conditions and liability waivers, as well as to local laws and regulations.

  1. VALIDITY & PRICING

Prices for trips are based on tariffs, government fees, exchange rates, and supplier rates effective at the time our trip itineraries are initially published. Although it is a rare occurrence, we may need to apply surcharges in situations where there is a significant increase in our costs due to inflation, service costs, fluctuations in foreign exchange rates, or other factors. Such surcharges could be imposed at any point up until the final payment is made.

We retain the right to modify and correct errors in quoted prices at any time before your trip is confirmed. Should we become aware of any pricing error, we will inform you of such error and the applicable price at the time of booking.

All discounts, reduced pricing, and/or promotional benefits are offered at the sole discretion of Merakiva Travel. We may, from time to time, provide special discounts or offer early bird pricing on select trips. Should you cancel a booking for a trip and later decide to re-book the same or a similar trip, you may not be eligible for any previously applied promotions or discounts.

  1. TRAVELER INFORMATION

To confirm your travel arrangements, you are required to provide all details requested at the time of booking. Essential information includes your full name as it appears on your passport, date of birth, nationality, and any pre-existing medical conditions or allergies that could impact your ability to fully participate in your travel arrangements. We may also require a copy of your passport prior to or during your trip.

The specific information needed from each traveler will vary depending on the trip, and this will be clearly communicated during the booking process. If all requested information is not provided within 91 days before the trip’s start date (or within the specified timeframe for bookings made less than 91 days before the start date), we reserve the right to apply late fees for missing information and, if necessary, enact the cancellation policy outlined in this agreement.

  1. FITNESS FOR TRIP, MEDICAL CONDITIONS & SPECIAL REQUIREMENTS

By booking a trip with Merakiva Travel, you declare that you are free from any illness, physical or other conditions that could pose a hazard to yourself or other travelers, or affect the enjoyment of the trip by others. Merakiva Travel cannot assure the condition or availability of medical facilities in the destinations we operate, which may include visits to remote or less developed areas. It is, therefore, crucial for travelers to consult with their physician regarding any medical conditions before booking a trip with Merakiva Travel.

Travelers should verify the latest health requirements with relevant consulates. It is necessary for travelers to bring their own medications, including insect repellent and any other prescribed drugs, such as allergy medication (e.g., EpiPen).

Should you have a special need, inform us at the time of booking. A medical certificate may be required for those with conditions that could impact their ability to participate in a trip. While we will endeavor to communicate any dietary restrictions to our guides and some service providers, we cannot guarantee that all dietary needs or restrictions will be met due to the nature of our trips and our relationship with suppliers. Merakiva Travel is not liable for any inability to accommodate or fulfill special requests or needs. It is your responsibility to inquire and make informed decisions regarding your dietary requirements while traveling.

By agreeing to this contract, you permit the administration of emergency first aid if necessary. In case of an emergency or health issue during the trip, Merakiva Travel will assist in obtaining medical help if available. However, the cost of any medical assistance, including routine care, will be the traveler’s responsibility. We strongly advise securing comprehensive medical and health insurance for your travels.

Our suppliers have the authority to perform common travel industry health screenings and refuse service to travelers showing symptoms of illness. Furthermore, they, along with government or health authorities, may quarantine travelers showing symptoms of infectious diseases.

Merakiva Travel reserves the right, at our sole discretion, to accept, decline, or remove any traveler from a trip (before departure or during the trip) if their participation is deemed to be a risk to themselves or others.

  1. AGE REQUIREMENT

Merakiva Travel’s multi-day trips are designed for groups of individuals aged 25 to 45 years. While we welcome guests outside this age range, Merakiva Travel reserves the right, at our sole discretion, to refuse service to individuals not falling within this specified range to ensure the compatibility and comfort of all travelers. This policy is in place to maintain the intended demographic focus of our trips, while also providing diverse travel products to accommodate a wider audience.

For other travel products provided by Merakiva Travel, including but not limited to custom curated trips and local walking tours, The Company’s age policy is specified on a per-product basis. In all cases, purchases must be made by individuals over the age of 18.

Countries have different age limits for the consumption of alcohol and other activities. You must ensure you satisfy the age limits before participating in any activity with age limits (such as the consumption of alcohol) and you release us from all liability and claims arising from your inability to participate in such activities.

  1. BOOKING CONFIRMATION

Your booking is considered provisional until you receive a confirmation email from us. A contractual agreement is established between us from the date we issue the confirmation invoice, or, if you book within 7 days of departure, the contract is formed when we accept your payment. Details regarding final payments will be provided in your booking confirmation invoice. For international trips, the remaining balance of the trip price is due 30 days prior to the departure date.

We reserve the right to consider any reservation not fully paid by the stipulated booking and payment terms as cancelled, subject to our cancellation policy.

  1. WAITLIST

If a trip offered by Merakiva Travel reaches its capacity, you have the option to join the Waitlist during the booking process. Should a spot become available, we will notify you via email. Upon receiving this notification, you will have 24 hours to accept the available spot and make the required deposit payment. If the offer is not accepted within this timeframe, the opportunity will be passed to the next individual on the Waitlist.

  1. DEPOSIT REQUIREMENTS

A non-refundable deposit is required to process and confirm your booking request with Merakiva Travel (“Deposit”). The specific amount of the Deposit varies by trip and is detailed on the respective trip booking page. Should Merakiva Travel, at its sole discretion, choose not to confirm your booking, your Deposit will be fully refunded. For bookings made within 60 days of the trip’s start date, the following payment schedule applies:

  • 60 Days Prior to Trip: 75% of the Trip Cost Due
  • 30 Days Prior to Trip: 100% of the Trip Cost Due
  1. PAYMENT SCHEDULE & REQUIREMENTS

If you opt for installment payments for your trip, you agree to adhere to the following payment schedule:

  • 90 Days Prior to Trip: 50% of the Trip Cost Due
  • 60 Days Prior to Trip: 75% of the Trip Cost Due
  • 30 Days Prior to Trip: 100% of the Trip Cost Due

Merakiva Travel is not liable for any fees incurred from third-party or financial institution transactions related to the purchase of trips or products. Such fees are the responsibility of the traveler and are non-refundable by us.

Should payment not be received by the due date, Merakiva Travel reserves the right to charge the owed amount to the credit card on file. Failure to process payment may lead us, at our discretion, to consider it a breach of contract, cancel your reservation, apply cancellation fees as outlined in this agreement, and potentially assign your spot to another traveler on the Waitlist without a refund to you.

  1. CREDIT/DEBIT CARD CHARGEBACK POLICY

By booking a trip with Merakiva Travel, you agree that initiating chargebacks is not a valid method for circumventing our cancellation and refund policy. We will actively contest any chargeback attempts, provide this agreement as evidence of your acceptance of our cancellation and refund terms, and may report fraudulent chargebacks to the relevant authorities. In the event that we prevail in a chargeback dispute initiated by you, you will be responsible for reimbursing us for any legal fees, time, costs, and expenses incurred in contesting the chargeback, in addition to compensating us for any damages resulting from the chargeback dispute.

  1. CANCELLATION BY TRAVELER

Cancellation of your booking will only be recognized and processed when we receive written notification of the cancellation from you via email at [email protected]. Cancellations communicated through any other means, such as comments on social media platforms, will not be considered valid or recognized as a formal cancellation. Upon cancellation, the following terms will apply based on the timing of our receipt of your written cancellation notice. Please be aware that certain itineraries might have specific cancellation rules, which will be detailed in the Trip Notes and Booking Instructions.

  • 61 days or more before departure: Deposit is non-refundable and issued as “Travel Credit” on your account, which can be transferred to another trip.
  • 60-31 days before departure: 50% of the trip cost is non-refundable. Any additional amounts paid will be refunded or converted into travel credit.
  • 30 days or less before departure: No refunds are possible.

By accepting our booking terms and conditions, you acknowledge that all transactions are conducted in US Dollars. Should any refunds or credits be issued after the original transaction, compensation will be in US dollars. Merakiva Travel is not responsible for fluctuating exchange rates, ensuring the US dollar amount of your payment and any refund will remain consistent.

Travel credit is valid for five years from the date of issuance. Travel credits are valid solely for products offered by Merakiva Travel Inc. Deposits or Travel Credits are not eligible for cash refunds under any circumstances.

No refunds will be provided if a traveler fails to join a trip, joins after its departure, or leaves before its completion, regardless of the reason. Once a trip has started, no refunds will be given for services not used.

Failure to make a payment by the due date will result in no refund being owed to the traveler, as this will be considered a breach of contract. If the total amount paid to Merakiva Travel is less than the non-refundable portion at the time of cancellation, the traveler will be required to pay an additional fee to cover unrecoverable costs.

Non-refundable deposits made to third-party suppliers and their cancellation fees will be deducted from any refunds or trip transfers due under this section. This may lead to a refund amount of $0 after deductions.

There are no exceptions to this cancellation and refund policy, even for reasons related to weather, terrorism, civil strife, airline default, strikes, personal, family, or medical emergencies, or any other circumstances beyond our control. This includes cancellations due to medical issues, viruses, sickness, quarantine, travel restrictions/warnings, fear of traveling, or any other reason. As such, we require that you obtain travel insurance to participate in a trip.

Refunds will not be provided for any unused portion of your trip if you are quarantined or if a supplier refuses services due to symptoms of or a positive test for an infectious disease. We will not be liable for any loss, damage, injury, or other consequences if you contract an illness, are refused services by a third party, or test positive for an infectious disease before, during, or after your trip. Examples include, but are not limited to, being denied boarding for a flight, denied entry by a government or municipality for lack of vaccination proof, refused service at a hotel for showing symptoms of an illness, or being unable to board a flight due to illness symptoms.

  1. CANCELLATION AND CHANGES BY MERAKIVA TRAVEL

Merakiva Travel reserves the right to cancel, alter, or postpone a trip without prior notice at any time prior to departure or after a trip commences for the safety and/or comfort of travelers, if it is not viable for us to operate the planned itinerary, or due to circumstances of Force Majeure (detailed explanation on Force Majeure provided below). Merakiva Travel will not be responsible or liable for deposits, payments, incidental expenses, policies, or penalties for other services not included in the trip price, such as airline tickets, separate hotel reservations, or other items handled by participants not through Merakiva Travel. Please consult your required travel insurance policy for details regarding expenses covered by your insurance carrier.

If a trip is cancelled due to reasons within Merakiva Travel’s control and not due to Force Majeure, we will offer you the following choices:

  • Travel credit equal to the trip cost that you have paid.
  • A refund equal to the trip cost that you have paid.

If a trip is cancelled due to a Force Majeure event, we can offer you the following choice:

  • Travel credit equal to the trip cost that you have paid minus any unrecoverable costs and monies. Unrecoverable costs and monies include, but are not limited to, deposit monies that we have received from you and forwarded to our suppliers, cancellation penalties imposed by third parties, and our current standard fee to cover work involved in planning, booking, and organizing your participation in a trip.

By agreeing to our booking terms and conditions, you acknowledge that you are purchasing your trip in US Dollars and should any refunds or credits be given at any point after the time of purchase, you will be compensated in US dollars. Merakiva Travel is not responsible for changes in and fluctuations of exchange rates, ensuring the US dollar amount of your payment and your refund will be the same.

If a cancellation occurs after a trip has commenced, we will offer the same choice on a pro-rata basis.

Merakiva Travel includes a fee of $200 in the trip price to cover the work involved in planning, booking, and organizing your participation from the moment the trip is booked. This fee, at the absolute discretion of Merakiva Travel, may be incorporated as an unrecoverable cost if a trip is cancelled, withdrawn, altered, modified, postponed, or rescheduled.

You understand and acknowledge that the nature of this type of travel requires considerable flexibility, and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities planned, but it is not a guarantee. While Merakiva Travel will do its best to operate all trips as advertised, reasonable changes in the itinerary may be made where deemed necessary by Merakiva Travel, in its sole discretion. The route, schedules, itineraries, amenities, restaurants, hotels, and mode of transport may be subject to alteration without prior notice due to availability issues, local circumstances, weather, or other unpredictable and unforeseen circumstances beyond the control of Merakiva Travel.

Though extremely rare, we reserve the right to impose surcharges up to 15 days before departure in case of significant changes in exchange rates, unforeseen increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action requires us to do so. In such instances, Merakiva Travel will cover amounts up to 2% of the trip price, and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price, you may cancel the booking within 7 days of notification of the surcharge and obtain a full refund, minus any unrecoverable costs.

We shall not be deemed to be in breach of this agreement or otherwise liable to you, by reason of delay in performance, or by non-performance, of any of our obligations hereunder as a result of any cancellations, alterations, or modifications under this section.

ADDITIONAL INFORMATION REGARDING FORCE MAJEURE

Merakiva Travel will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” includes circumstances beyond our reasonable control, such as acts of nature and/or God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, pandemics, epidemics, diseases and viruses that are known, unknown, or novel, government intervention affecting travel, border closings, weather conditions, and other unforeseen circumstances.

If Force Majeure prevents, significantly hinders, or makes it impractical or impossible for us or our suppliers to provide services, including your trip, we and our suppliers are entitled to, and may in our complete and sole discretion, vary, delay, postpone, reschedule, alter, or cancel any itinerary or arrangement relating to the tour, including the entire tour itself.

In cases of civil unrest, we will assess the situation as we deem fit, and it remains at our sole discretion whether to proceed with the tour.

Should we be affected by Force Majeure, we will notify you of the nature and extent thereof, if practicable.

ADDITIONAL INFORMATION REGARDING COVID-19 POLICY

If you test positive during your trip, you must follow all local laws, which may include isolating. This could mean not continuing with the group. If your health condition could jeopardize you or others, you may be asked to leave the trip.

Should you be unable to travel or need to cut your trip short, our standard cancellation fees apply. We are not responsible for any costs associated with trip curtailment, missed transport, additional accommodation, or related expenses. Ensure your travel insurance covers these situations.

  1. INCLUSIONS & EXCLUSIONS

The transportation, accommodations, activities, meals, and drinks provided by Merakiva Travel are specific to each trip and are listed on the trip booking page. Any services not expressly listed as included on the trip booking page are not covered by Merakiva Travel and are the financial responsibility of the traveler. Additionally, our trips do not include flights, visa and passport fees, vaccinations, travel insurance, optional activities, or other personal expenses.

  1. OPTIONAL ACTIVITIES & SUPPLEMENTALS

Merakiva Travel may offer optional activities and other supplemental charges (e.g., single room upgrades), which are specific to each trip and departure date. Merakiva Travel will review all optional and supplemental requests, and will provide final approval once we confirm availability.

Optional activities and supplementals that are not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by a Merakiva Travel employee or contractor, or local representative in arranging optional activities does not render Merakiva Travel liable for them in any way. The contract for the provision of that activity will be between you and the activity provider. Furthermore, Merakiva Travel reserves the right to cancel or modify optional activities and supplementals based on availability, local constraints, weather, and other unforeseen circumstances. If we cancel an optional activity or supplemental, Merakiva Travel will provide the traveler with a full refund. Merakiva Travel will not be liable for any losses associated with any changes to or cancellations of optional activities or supplementals.

  1. TRIP TRANSFERS AND TRAVEL CREDITS

If transferring trips or dates, any deposits/amounts paid by you to date become non-refundable and can only be used as travel credit. The following terms apply to all trip transfers and travel credits:

For trips scheduled more than 60 days in advance, we allow one complimentary trip transfer. Additional trip transfers will incur a change fee of $100. Transfers requested within 60 days of departure are subject to our regular cancellation fees.

Once travel credit has been accepted by you under any circumstance, it is not eligible to be redeemed for cash, which includes but is not limited to credit card refunds.

When transferring trips or dates, your booking will be subject to the latest version of Merakiva Travel’s Terms & Conditions, a copy of which will be available on our website.

All reservation transfers to other travelers must be approved by Merakiva Travel, and you will be responsible for a $100 transfer fee. If you wish to have someone fill your spot or transfer your credit, please contact us at [email protected].

Merakiva Travel will not not charge for name corrections, however where third party costs are incurred these will be passed on to the guest, paid in the guest’s original payment currency at the current exchange rate of the third party costs.

  1. YOUR ACCOUNT

To participate in Merakiva Travel’s services, you may be required to create an account, selecting a password and user name (“User ID”). It is your responsibility to provide accurate, complete, and updated registration information. You must not select a User ID that infringes upon the rights of any third party or is intended to impersonate another individual. Transferring your account to someone else is not allowed without Merakiva Travel’s prior written consent. You are expected not to share your account or password with others and to maintain the security of both. You bear full responsibility for all activity conducted through your account.

  1. PASSPORTS, VISAS, AND OTHER TRAVEL DOCUMENTATION

It is your responsibility to carry a valid passport and obtain all necessary visas, permits, certificates, proof of vaccinations, and other travel documentation for all the countries you will visit during your trip. Your passport must be valid for at least 6 months beyond the duration of the trip. Ensuring compliance with all entry requirements and possession of the correct visas, permits, and certificates for your trip is solely your responsibility, including the accuracy of all information on those documents. Merakiva Travel cannot be held responsible if you are denied entry to a country due to incorrect or incomplete passport, visa, or other travel documents.

You alone are accountable for any adverse effects, including additional costs and fees, resulting from incomplete or incorrect documentation. While Merakiva Travel may offer information or advice on visas, vaccinations, climate, clothing, baggage, and special equipment as a courtesy, we do not accept responsibility for any mistakes or oversights in the information provided.

For advice on potential risks at international destinations, consult the government office in your country responsible for issuing travel advisories. In the U.S., you can reach the Travel Advisory Section of the U.S. State Department at 1-888-407-4747 or visit http://www.travel.state.gov/. U.S. citizens might consider enrolling in the Smart Traveler Enrollment Program (STEP) at https://step.state.gov/step/, a free service offered by the U.S. government. For medical information, the U.S. Centers for Disease Control (CDC) can be contacted at 800-232-4636 or through their website at http://wwwnc.cdc.gov/travel/, or you may contact the appropriate government agency in your country.

  1. PRE-DEPARTURE DOCUMENTATION

You must read all trip-related documents received from us immediately. It is your responsibility to inform us of any inaccuracies within 10 days of receipt. Failure to submit required documents, including this agreement, Traveler Pledge, Release of Liability, Health Declaration Form, and any necessary medical certifications, may result in your booking being treated as cancelled with applicable cancellation fees.

  1. AIRLINE DELAYS, MODIFICATIONS, AND CANCELLATIONS

Merakiva Travel is not liable for errors in airfare bookings made independently by the traveler or third parties. We will provide trip arrival and departure requirements via email once flights are confirmed. You are responsible for ensuring correct flight information and adhering to airline baggage allowances and guidelines. Any costs from airline changes, delays, or strikes are the traveler’s responsibility, and Merakiva Travel will not cover additional expenses incurred from such events.

  1. TRAVEL INSURANCE

Travel insurance is mandatory for all travelers and should be purchased at the time of booking. Your policy must cover personal accident, death, medical expenses, and emergency evacuation, including Covid-related trip interruptions. You are responsible for ensuring your policy covers your travel type, destinations, and activities. We also highly recommend that your travel insurance also covers Covid-related trip interruptions. Proof of travel insurance must be provided at least two weeks before the trip start date. You are responsible for advising your insurer of the type of travel, destination(s) and activities included in your booking so that the insurer may provide appropriate coverage. Failure to provide proof by the start date will result in being unable to join the trip, without eligibility for refunds due to this issue.

  1. TRAVELER RESPONSIBILITIES DURING TRIP

As a traveler with Merakiva Travel, you agree to adhere to the Traveler Pledge throughout your journey. Failure to comply may lead to your removal from the trip or a ban from future trips. It is your responsibility to be prepared to depart from the designated city at the specified time and date. Merakiva Travel is not liable for any losses incurred due to cancelled or missed flights, changes in flight schedules, late arrivals, or early departures. Additional responsibilities include adhering to all local laws, including measures for virus/sickness/illness mitigation such as social distancing and testing requirements, respecting local customs and culture, accurately assessing your abilities, and, if participating in a guided trip, following the guidance and advice of the trip leader.

  1. CLAIMS & COMPLAINTS

Should you have a complaint during your trip, you are required to inform your trip leader or our Support Team at [email protected] immediately to allow for the opportunity to address the issue. Merakiva Travel assumes no liability for complaints not promptly reported to your trip leader or Support Team with adequate notice for resolution. Complaints post-trip must be submitted via email to [email protected] within 15 days following the trip’s conclusion. Acknowledgement and agreement that Merakiva Travel is under no obligation to respond to or act upon any claims received after this period are essential.

  1. AUTHORITY ON TRIPS

Merakiva Travel trips are led by a designated trip leader, whose decisions regarding any matter that might affect the safety or well-being of participants are final. Each trip leader serves as the representative of Merakiva Travel during the period of the trip. Non-compliance with the trip leader’s decisions or actions that disrupt the group’s well-being or mobility may result in immediate removal from the trip without any entitlement to a refund. Furthermore, such conduct may result in a refusal by Merakiva Travel to include you in any future trips, including those already booked. You also agree to abide by the laws, customs, foreign exchange, and drug regulations of all countries visited, in addition to adhering to our responsible travel guidelines.

  1. LIMITATION OF REMEDIES

You agree that the sole remedy for any default by Merakiva Travel under this agreement shall be the return of the paid trip cost, to the extent that it is consistent with applicable law. To the maximum extent permitted under applicable law, Merakiva Travel shall not be liable for any special, consequential, indirect, incidental, or other damages arising out of this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Merakiva Travel has been advised of the possibility of such damages. You expressly waive any right to recover such damages.

  1. SUCCESSORS AND ASSIGNS

This agreement shall benefit and be binding upon Merakiva Travel and you, including your respective heirs, legal and personal representatives, successors, and assigns.

  1. SEVERABILITY

Should any provision of this agreement be unenforceable or invalid under applicable law, such unenforceability or invalidity shall not render the entire agreement unenforceable or invalid. An unenforceable provision will be replaced with a valid and enforceable one that, as much as possible, achieves the original objectives and intent of the original provision.

  1. DISCLAIMER

Travel is personal and each traveler’s goals and experiences may differ. Merakiva Travel will not be bound by, or liable for, any description, photograph, representation or warranty made by or provided by any independent third party sales representative, Travel Agent, or other person or entity relating to any vacation offered by The Company.

  1. IMAGES RELEASE AND SOCIAL MEDIA

By participating in a Merakiva Travel trip, you grant Merakiva Travel the right to use, re-use, link to, repost, and reproduce any images, photos, videos, or written content (e.g., blog posts, articles) that you send to us, that are taken by our guides, trip leaders, and/or other travelers of you individually or in a group, or that you post online including on social media using our hashtags, in any medium, including but not limited to print, electronic media, or the Internet, without charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide. We will strive to provide attribution whenever possible. If you wish to opt out of this Images Release, you must contact us in writing at [email protected] before the start of your trip, clearly stating your intention to opt out.

  1. APPLICABLE LAW

All Merakiva Travel trips, products, bookings, and reservations (including but not limited to those made online), policies, and terms and conditions are subject to the laws of Commonwealth of Pennsylvania, and all travelers submit to the exclusive jurisdiction of the state and federal courts located in Pennsylvania, United States, for the resolution of any dispute under these terms and conditions or concerning Merakiva Travel.

  1. AMENDMENTS TO TERMS & CONDITIONS

Merakiva Travel reserves the right to update and/or alter these terms and conditions at any time, and will post the amended terms and conditions on the Merakiva Travel website. Any amendment shall take effect immediately upon being posted to the Merakiva Travel website or immediately upon notice to you in writing via email. You are deemed to have accepted any amendments to these terms on the date they are posted on our website or when we provide notice to you in writing via email. Your continued use of the services, participation in one of our trips, or use of the Merakiva Travel website constitutes acceptance of any amendments. The latest terms and conditions, as amended, may be accessed at any time on the Merakiva Travel website and are available upon written request via email to [email protected]. All travelers and Merakiva Travel customers are deemed to have accepted any amendments to these terms and conditions 7 days after their posting on the Merakiva Travel website.

  1. REFUSAL OF SERVICE

Merakiva Travel retains the right to refuse service to any traveler or potential client at any time, for any lawful reason, in its sole discretion.

  1. MERGER

This agreement constitutes the final, complete, and exclusive statement of the parties’ agreement on the matters contained in this agreement, superseding all previous negotiations and agreements.

ACKNOWLEDGEMENT

I have read this entire agreement and understand that it is a legally binding contract. No other representations concerning the legal effect of this document have been made to me.

KNOWING AND VOLUNTARY EXECUTION: I have had sufficient time to read this entire agreement. I have carefully read and understand its provisions and legal consequences, and I voluntarily agree to all of its terms and conditions. I understand that by accepting the terms of this agreement, I am giving up substantial rights. I acknowledge that it has been recommended that I have my attorney review this agreement prior to accepting it.
